Exceptional Hardship

Are you totting up Penalty Points? Let us argue Exceptional Hardship and help you save your driving licence.

What is Exceptional Hardship?

When a driver reaches 12 penalty points in any 3 year period, the Court guidelines are an immediate ban of 6 months or more. Prior to considering whether a ban should be imposed, the Court will give the Defendant the opportunity to raise an Exceptional Hardship argument in order to persuade the Court that a ban should not be imposed.

The only circumstances that can prevent a 12 point driving ban is the finding of Exceptional Hardship. It must be clear that hardship is beyond that of which would normally be suffered by depriving the driver of their license.

At TrafficLawyer4u we have over 25 years experience in successfully appealing Exceptional Hardship cases.

Avoid a Driving Ban

Following a conviction under the Road Traffic Act there is a penalty of an obligatory endorsement of penalty points or an obligatory disqualification. We may be able to avoid this for you if we can establish Exceptional Hardship. Even if you are convicted of an offence or there is no viable defence to it, we believe as expert traffic lawyers that we can help you.

Remember the sooner work begins on your Exceptional Hardship case the better. Do not be tempted to forget about it and hope it will go away, It Won't.
